Fines for Failing to Comply
Beginning on July 1st, 2021, once a new or renewed contract is signed on a Wainuiomata rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.
Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on the Wainuiomata rental property, all Healthy Homes compliance work must be completed within 90 days.
Failure to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.
Anyone can request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager does not provide the required information within 21 days of having received the inquiry, they will be issued an infringement notice and be fined up to $750.
In addition, there’s also a fine of up to $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is named on the lease agreement as the person who is leasing the property out, so it could be the name of the landlord, or the property management company.
All the information on the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed. It should be kept updated throughout the tenancy as any associated work has been completed.
It is also important to be aware that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The highest penalties are given for severe violations. Those who have at least six rental properties could be penalised up to $50,000, and as much as $100,000 in hearing claims.
